1973 Constitution of Pakistan

Federal Shariat Court
“The Federal Shariat Court was established on 26th May, 1980 by the President’s Order ... This Court is a unique institution with no parallel in the entire Muslim world. It is backed by powerful provisions of the Constitution. The preamble of the Constitution explicitly affirms that sovereignty over the entire universe belongs to Almighty Allah alone and the authority to be exercised by the people of Pakistan within the limits prescribed by Him is a sacred trust. ... Article 227 makes it incumbent that all existing laws shall be brought in conformity with the injunctions of Islam ...”

When the Federal Shariah Court was free to listen to cases:
- The first petition for the abolition of the interest-based banking system in the country was filed in the FSC on June 30, 1990.
- The then chief justice of the FSC, Dr Tanzeelur Rehman, had constituted a three-member bench that delivered judgment in the case on November 14, 1991, and sought its implementation by April 30, 1992.
- The then PML-N government had challenged the decision in the apex court.

Selling What One Does Not Possess (1)
عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم « مَنِ ابْتَاعَ طَعَامًا فَلاَ يَبِعْهُ حَتَّى يَقْبِضَهُ »
Narrated by Ibn Abbas (r.a) that the Messenger of Allah (s.a.w) said, “He who buys foodgrain should not sell it until he has taken possession of it.”
[Muslim, Book on Business Transactions (21), 3838]
Selling What One Does Not Possess (2)
عَنْ حَكِيمِ بْنِ حِزَامٍ، قَالَ أَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقُلْتُ يَأْتِينِي الرَّجُلُ يَسْأَلُنِي مِنَ الْبَيْعِ مَا لَيْسَ عِنْدِي أَبْتَاعُ لَهُ مِنَ السُّوقِ ثُمَّ أَبِيعُهُ قَالَ « لاَ تَبِعْ مَا لَيْسَ عِنْدَكَ »
Hakim b. Hizam (r.a) narrated, “I came to the Messenger of Allah (s.a.w) and asked, ‘A man comes to me and asks to buy something which I did not have. Can I purchase it from the market for him and then sell it to him?’ He (s.a.w) replied, ‘Do not sell what is not with you.’”

Conditions to Buy or Sell In Advance
عَنِ ابْنِ عَبَّاسٍ، قَالَ قَدِمَ النَّبِيُّ ـ صلى الله عليه وسلم ـ وَهُمْ يُسْلِفُونَ فِي التَّمْرِ السَّنَتَيْنِ وَالثَّلاَثَ فَقَالَ « مَنْ أَسْلَفَ فِي تَمْرٍ فَلْيُسْلِفْ فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ إِلَى أَجَلٍ مَعْلُومٍ »
Narrated by Ibn Abbas (r.a), “When the Prophet (s.a.w) came (to Madina), they used to pay in advance for dates, two or three years in advance. He (s.a.w) said, ‘Whoever pays in advance for dates, let him pay for a known amount or a known weight, to be delivered at a known time.’”

One of the Signs of the Day of Judgement
عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ « يَأْتِي عَلَى النَّاسِ زَمَانٌ، لاَ يُبَالِي الْمَرْءُ مَا أَخَذَ مِنْهُ أَمِنَ الْحَلاَلِ أَمْ مِنَ الْحَرَامِ »
“Narrated by Abu Hurairah (r.a) that the Prophet (s.a.w) said, ‘A time will come when one will not care how he earns money, halal or haram.’”
[Sahih Al-Bukhari, Kitab Al-Fazal Laila tul Qadar (32), 2059]
The First Form of Riba that was Prohibited Consuming Double & Multiplied Interests
يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا الرِّبَا أَضْعَافًا مُّضَاعَفَةً وَاتَّقُوا اللَّهَ لَعَلَّكُمْ تُفْلِحُونَ ۞
“O you who believe! (Do) not eat Riba doubled, re-doubled. And consciously revere Allah so that you may (be) successful.”
[Surah Ale-Imran (3), Ayat 130]
The Bad Smell that Causes Angels of Blessings to Leave a Liar
عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ « إِذَا كَذَبَ الْعَبْدُ تَبَاعَدَ عَنْهُ الْمَلَكُ مِيلاً مِنْ نَتْنِ مَا جَاءَ بِهِ »
Narrated by Ibn Umar (r.a) that the Messenger of Allah (s.a.w) said, “When the slave (of Allah) lies, the angel goes a mile away from him because of the stench of what he has done.”

عَنْ عَبْدِ اللهِ، عَنِ النَّبِيّ صلى الله عليه وسلم قَالَ « الرِّبَا ثَلَاثَةٌ وَّسَبْعُوْنَ بَابَا، أَيْسَرُهَا مِثْلَ أَنْ يَنْكِحَ الرَّجُلُ أُمَّهُ ... »
[Hakim, 5852] (Sahih)
عَنْ عَبْدِ اللَّهِ بْنِ حَنْظَلَةَ غَسِيلِ الْمَلَائِكَةِ قَالَ قَالَ رَسُولُ اللَّهِ « دِرْهَمٌ رِبًا يَأْكُلُهُ الرَّجُلُ وَهُوَ يَعْلَمُ أَشَدُّ مِنْ سِتَّةٍ وَثَلَاثِينَ زَنْيَةً »

State of Those Who Consume Riba
On Judgement Day
الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ ذَٰلِكَ بِأَنَّهُمْ قَالُوا إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَن جَاءَهُ مَوْعِظَةٌ مِّن رَّبِّهِ فَانتَهَىٰ فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ وَمَنْ عَادَ فَأُولَٰئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَ ۞

عَنْ جَابِرٍ، قَالَ لَعَنَ رَسُولُ اللَّهِ صلى الله عليه وسلم آكِلَ الرِّبَا وَمُوكِلَهُ وَكَاتِبَهُ وَشَاهِدَيْهِ وَقَالَ هُمْ سَوَاءٌ
“Narrated by Jabir that the Messenger of Allah (s.a.w) cursed accepter of interest and its payer, and one who records it, and the two witnesses, and he said, ‘They are all equal.’”

Less is Better Which Cannot Destroy You
عَنْ أَبِي الدَّرْدَاءِ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا طَلَعَتْ شَمْسٌ قَطُّ إِلَّا بُعِثَ بِجَنْبَتَيْهَا مَلَكَانِ يُنَادِيَانِ يُسْمِعَانِ أَهْلَ الْأَرْضِ إِلَّا الثَّقَلَيْنِ يَا أَيُّهَا النَّاسُ هَلُمُّوا إِلَى رَبِّكُمْ فَإِنَّ مَا قَلَّ وَكَفَى خَيْرٌ مِمَّا كَثُرَ وَأَلْهَى وَلَا آبَتْ شَمْسٌ قَطُّ إِلَّا بُعِثَ بِجَنْبَتَيْهَا مَلَكَانِ يُنَادِيَانِ يُسْمِعَانِ أَهْلَ الْأَرْضِ إِلَّا الثَّقَلَيْنِ اللَّهُمَّ أَعْطِ مُنْفِقًا خَلَفًا وَأَعْطِ مُمْسِكًا مَالًا تَلَفًا

Dedicating Ownself for the Path of Allah
عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ « إِنَّ اللَّهَ تَعَالَى يَقُولُ يَا ابْنَ آدَمَ تَفَرَّغْ لِعِبَادَتِي أَمْلأْ صَدْرَكَ غِنًى وَأَسُدَّ فَقْرَكَ وَإِلاَّ تَفْعَلْ مَلأْتُ يَدَيْكَ شُغْلاً وَلَمْ أَسُدَّ فَقْرَكَ »
Narrated by Abu Hurairah (r.a) that the Prophet (s.a.w) said, “Indeed Allah, Most High said, ‘O son of Adam! Devote yourself to My worship, I will fill your chest with riches and alleviate your poverty. And if you do not do so, then I will fill your hands with problems and not alleviate your poverty.’”

Who is the Most Worshipping of Allah
عَنْ أَبِي هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ « من أَخذ عَنِّي هَؤُلَاءِ الْكَلِمَاتِ فَيَعْمَلُ بِهِنَّ أَوْ يُعَلِّمُ مَنْ يَعْمَلُ بِهِنَّ » قُلْتُ أَنَا يَا رَسُولَ الله فَأخذ بيَدي فَعَدَّ خَمْسًا فَقَالَ « اتَّقِ الْمَحَارِمَ تَكُنْ أَعْبَدَ النَّاسِ ...»
Narrated by Abu Hurairah (r.a) that Allah’s Messenger (s.a.w) said, “Who will take from me these statements to act upon or teach them one who will act upon them?” So Abu Hurairah (r.a) said, “I said, ‘I shall O Messenger of Allah!’ So he (s.a.w) took my hand and enumerated five (things), he said, ‘Be on guard against the unlawful and you shall be the most worshipping among the people ...
